Habeas corpus allows any person deprived of liberty to obtain, without delay, an independent judge's ruling on the lawfulness of their detention. Rooted in the Magna Carta and codified in 1679, it is guaranteed by Article 9 of the ICCPR and Article 5 of the European Convention on Human Rights.
